Terms of Service (ToS) & Acceptable Use Policy
This Terms of Service agreement (the "Agreement") is a legally binding contract between JordanHost LLC, a limited liability company duly organized and existing under the laws of the State of Wyoming, United States of America (referred to as "JordanHost", "we", "us", "our", or the "Platform"), and the user (referred to as the "Client", "you", or "your"). JordanHost LLC is the legal operating entity of the JordanHost platform, serving clients in Jordan, the MENA region, and worldwide with web hosting, domain registration, and IT services. By purchasing, accessing, or using our products, services, and website, you unconditionally agree to be bound by all terms and policies outlined herein. If you do not agree to these terms, you are strictly prohibited from using our services.
1. Eligibility & Account Requirements
- Legal Age: You must be at least eighteen (18) years of age to use our services. Use of our services by minors is a strict violation of this Agreement.
- Authority to Bind: If you are utilizing our services on behalf of a corporate entity or third party, you warrant that you possess the legal authority to bind said entity to this Agreement.
- Data Accuracy: The Client must provide accurate, current, and complete contact information. Your primary account email must differ from the domain(s) hosted with us to ensure emergency communication. Falsified or inaccurate data may result in immediate account termination.
- Identity Verification (KYC): To comply with United States financial regulations and the requirements of our payment processors and banking partners, we reserve the right to request government-issued identification or business documentation to verify your identity ("Know Your Customer") before activating or continuing any service. Refusal to complete verification may result in suspension of the account and associated services.
- Account Security: You are solely responsible for the security of your account, including maintaining the confidentiality of your usernames and passwords. You must use strong passwords. The Platform reserves the right to suspend accounts utilizing weak credentials until they are updated.
2. Billing & Payment Policy
- Advance Payment: All services must be paid for in full prior to deployment or renewal. All transactions are processed in United States Dollars (USD) through PCI-DSS compliant payment gateways.
- Automatic Renewal: Services operate on an auto-renewal basis. Renewal invoices are automatically generated twenty-five (25) days prior to the service expiration date to ensure continuous operation.
- Late Payments: A grace period of three (3) days is granted post-due date. Failure to remit payment beyond this period will result in service suspension. For Dedicated Servers, failure to pay will result in immediate suspension and permanent data erasure post-grace period.
- Billing Disputes: Any inquiries or disputes regarding billing must be submitted within ninety (90) days of the invoice date.
- Payment Security (3-D Secure): We may require Strong Customer Authentication (e.g., 3-D Secure) on card transactions. We reserve the right to decline any transaction that fails our fraud-screening controls.
- Fraudulent Activity: The use of stolen credit cards or fraudulent payment methods constitutes a severe breach of this Agreement and will be immediately reported to the appropriate law enforcement and financial authorities.
3. Refunds, Money-Back Guarantee & Cancellation Policy
- 3-Day Money-Back Guarantee (Shared Hosting Only): New Shared Hosting subscriptions are covered by a three (3) day money-back guarantee, calculated from the initial date of service activation. To exercise this guarantee, the Client must submit a refund request via a support ticket from the registered Client Area within the 3-day window. This guarantee applies exclusively to first-time purchases of Shared Hosting plans and may be used only once per Client.
- All Other Services Are Final: With the sole exception of the 3-Day Money-Back Guarantee for Shared Hosting stated above, all payments made to the Platform are strictly final, non-cancellable, and non-refundable. This includes, without limitation: Domain Name Registrations, Renewals, and Transfers; Virtual Private Servers (VPS); Dedicated Servers; SSL Certificates; Software Licenses; Premium Support plans (Priority Care, Technical Care, Digital Asset Protection, and VIP Care); Setup Fees; and all add-on services.
- Trial & Evaluation: If you are uncertain whether a service meets your project requirements, we strongly advise purchasing the shortest available billing cycle (e.g., one month of Shared Hosting). If satisfied, you may upgrade to a longer billing cycle (e.g., annually) directly from your client portal.
- Cancellation Protocol: Because the system generates auto-renewal invoices twenty-five (25) days in advance to allow corporate clients ample time for financial processing, you must submit any cancellation request within the first five (5) days of your current billing cycle. Cancellations must be executed independently via the Client Area.
4. Resource Usage & Technical Responsibilities
- Exclusive Use of Shared Hosting: A single Shared Hosting plan is strictly provisioned for hosting one (1) primary website or project belonging to the account owner. The term "Unlimited Domains" explicitly refers to parked domains, aliases, or addon domains that redirect to or support the same primary project. Hosting independent third-party websites (e.g., acting as an unauthorized reseller) under a single shared plan is strictly prohibited and will result in immediate account termination without prior notice.
- Data Migration: Website migration is offered as a complimentary courtesy service. We provide no guarantees regarding its complete success due to differing hosting environments. We bear no liability for any data loss during migration.
- Data Backup Responsibility: The Client assumes sole responsibility for maintaining off-site backups of their data, files, and databases. The Platform expressly disclaims any liability for lost or corrupted data.
- Acceptable Use Policy (AUP): Shared hosting is subject to fair use. Utilizing shared storage for cloud archiving, file dumping, or mass storage is strictly forbidden. We reserve the right to throttle or suspend accounts consuming excessive CPU/RAM resources that negatively impact other users.
- Service Level Agreement (SLA): We guarantee a 99% network uptime for Shared Hosting. In the event of an SLA breach, the Client may request account credit within 30 days. Scheduled maintenance is excluded from this guarantee.
5. Standard Technical Support Boundaries
Basic technical support is provided exclusively via our "Ticketing System" for all standard plans (Shared, VPS, Dedicated, Domains). Our basic support is strictly limited to maintaining server infrastructure stability. The operational management of your website remains entirely your responsibility.
- Included in Basic Support:
- Server Maintenance: 24/7 monitoring, OS security patching, and network troubleshooting.
- Service Stability: Fixing server-side downtime and global database service crashes.
- Webmail & Control Panel: Ensuring email routing functionality via Webmail and resolving cPanel/WHM access issues.
- Excluded from Basic Support:
- Unsupported Channels: No phone, WhatsApp, or live chat support is provided for basic plans.
- Third-Party Software: No troubleshooting for third-party scripts, CMS installations, plugins, or themes.
- Internal Security & Outdated Scripts: Our servers run on highly secure CloudLinux environments. If your site is compromised due to outdated plugins or script vulnerabilities, we will not clean your files. The account will be suspended to protect the network from outbound spam until you resolve the breach.
- Development & Debugging: We do not write code, modify HTML/CSS, or analyze PHP error logs to debug your application.
- Content Management: We do not update your CMS (e.g., WordPress), upload images, or manage e-commerce platforms.
- External Configurations: We do not configure external DNS records, link external domains, or install third-party SSL certificates.
- Database Repair & Resource Bumps: We do not repair corrupted database tables or temporarily increase RAM/CPU limits; an upgrade is required if limits are exhausted.
6. Premium Support Plans (VIP Client Care)
In addition to Basic Support, JordanHost LLC offers four distinct paid premium support tiers. Each tier is an independent, subscription-based service with its own scope. All premium tiers are available to any organization, whether or not the website is hosted with us, are billed annually, and are strictly non-refundable in accordance with Section 3. The scope of each tier is exhaustively defined below; any service not expressly listed within a tier is excluded from it.
6.1 Priority Care (Absolute Priority)
A response-time and communications upgrade. This tier does not alter the technical scope of Basic Support; it upgrades how and how fast you reach us.
- Direct Channels: Phone and WhatsApp support, available 24/7/365, in addition to the standard Ticketing System.
- Priority SLA: Top-priority queue placement with a guaranteed response within minutes.
- Individual Uptime Monitoring: Dedicated monitoring of the Client's website with proactive downtime alerts, beyond central infrastructure monitoring.
- Queue Bypass: Guaranteed bypass of standard support queues.
- Scope Limitation: Priority Care does not include code fixes, CMS management, or security remediation; those services require the Technical Care, Digital Asset Protection, or VIP Care tiers respectively.
6.2 Technical Care
A managed technical-operations tier that extends beyond infrastructure into the application layer of the Client's website.
- Script & Template Updates: Safe, scheduled updates of CMS platforms, scripts, themes, and plugins.
- Code Error Resolution: Direct, immediate intervention to diagnose and fix code-level errors (e.g., PHP errors, internal database failures).
- Performance Optimization: Advanced tuning of caching, databases, and assets for maximum load speed.
- Storage & Resource Management: Advanced management of disk space and resource consumption.
- Channels: Support under this tier is delivered via the Ticketing System. Direct phone and WhatsApp channels require an active Priority Care subscription.
- Scope Limitation: Technical Care does not include new feature development, custom design work, or advanced security services (see Digital Asset Protection and VIP Care).
6.3 Digital Asset Protection
A managed security tier engineered to protect the Client's website, data, and digital assets.
- Full Technical Management: Comprehensive management of the server and website.
- Breach & Malware Response: Free, immediate cleanup of compromised files (in contrast to Basic Support, under which compromised accounts are suspended pending Client remediation).
- Web Application Firewall: Advanced filtering against code-level vulnerabilities and exploits.
- Application-Layer DDoS Protection: Mitigation of distributed denial-of-service attacks at the application layer.
- Advanced Encryption: Advanced SSL/TLS certificates beyond the standard free tier.
6.4 VIP Care (Enterprise Care)
Our highest tier: an enterprise-grade, fully managed protection and administration program. VIP Care includes everything in Digital Asset Protection, plus:
- Dedicated Technical Account Manager: A designated expert who understands your project architecture, eliminating the need to explain issues from scratch.
- Preemptive Hardening & Penetration Testing: Periodic ethical penetration testing by information-security engineers to patch vulnerabilities before exploitation.
- Dedicated Smart Application Shield: Custom-configured protection that stops complex attacks before they reach your website.
- Advanced DDoS Mitigation: Resilient infrastructure engineered to absorb and disperse the most severe distributed attacks.
- Smart Resource Control: Automated controls that prevent bogus traffic from draining resources.
- Global Blocklists: Auto-updating security lists that block known attackers worldwide.
- Enterprise Encryption: Enterprise-grade certificates with highly sophisticated encryption algorithms.
- Seamless Verification: Smart bot filtering that does not disrupt legitimate visitors.
- Sensitive Data Leak Detection: Alerting systems designed to help prevent leaks of customer or financial data.
- Zero Trust Authentication: Strict verification gateways that fully restrict access to sensitive administrative pages.
- Legal Liability & Financial Compensation (SLA): Exclusively under the VIP Care tier, the Platform accepts contractual liability to compensate the Client for damages directly resulting from proven gross negligence, server misconfigurations by our staff, preventable security breaches, or failure to meet the uptime SLA, as set out in a separately executed SLA contract.
7. Zero-Tolerance Acceptable Use Policy (Prohibited Activities)
The following content and activities are absolutely and unconditionally prohibited across all JordanHost LLC services, including free, shared, VPS, dedicated, and reseller services. Violation of any item in this Section will result in immediate and permanent termination of all associated services without prior notice and without any refund, and, where applicable, referral to the competent authorities:
- Unauthorized Streaming & Broadcasts: Illegal IPTV services, live sports streaming, pirated movie and TV show websites, and any platform enabling unauthorized online viewing or live broadcasting.
- Software & Gaming Piracy: Unauthorized distribution of cracked software, video games, modifications, or operating unauthorized private game servers (including but not limited to GTA private servers, MMORPG private servers, or illicit multiplayer networks).
- Digital Media: Copyrighted audio files, e-books, premium courses, or any other digital assets shared without explicit permission from the rights holder.
- Malware: Uploading, storing, or distributing viruses, ransomware, hacking tools, exploit kits, or injected malicious code of any kind.
- Phishing: Hosting forged pages impersonating legitimate companies, banks, or institutions for the purpose of harvesting user credentials or data.
- Spam: Sending unsolicited bulk email (UBE/UCE), or exploiting website vulnerabilities to conduct spam operations from our network.
- Pornographic Content: Hosting sexual or adult materials of any kind. Any child sexual abuse or exploitation material will be reported immediately to international law enforcement authorities, together with all available account and access records.
- Gambling & Betting: Operating online gambling platforms, sports betting sites, lottery scripts, or pyramid/Ponzi schemes.
- Digital Attacks: Utilizing our infrastructure to participate in DDoS attacks, operate botnets, or conduct network vulnerability scanning against third parties.
We reserve the right to determine, at our sole discretion, whether any content or activity violates this Section, and to preserve and disclose evidence to law enforcement and financial institutions as required by law.
8. Global Domain Registration Terms
The registration and administration of global domains are governed by international regulations to protect all parties:
- ICANN Compliance: As a provider of gTLD registrations (e.g., .com, .net, .org), all registrations are subject to the Internet Corporation for Assigned Names and Numbers (ICANN) policies. We and the primary Registrar reserve the right to suspend, cancel, or transfer any domain to ensure ICANN compliance or protect registry integrity.
- WHOIS Accuracy & Mandatory Verification: The Client must provide accurate and up-to-date WHOIS data. ICANN requires email verification within fifteen (15) days of registration or modification. Failure to verify will result in immediate domain suspension.
- Expiration, Renewal, and RGP: It is the Client's responsibility to renew domains before expiration. Post-expiration, a domain enters a Grace Period followed by a Redemption Grace Period (RGP) (typically 30-45 days). Restoring a domain during RGP incurs substantial penalty fees set by the Registrar.
- WHOIS Privacy: We offer WHOIS Privacy to mask your public information. However, we reserve the right to disable this service and disclose your identity to comply with court orders, intellectual property disputes, or law enforcement requests.
- Uniform Domain-Name Dispute-Resolution Policy (UDRP): The Client agrees to be bound by the ICANN UDRP. In the event of a trademark or intellectual property dispute, we reserve the right to lock or suspend the domain pending arbitration or legal resolution.
9. Free Hosting Terms & Conditions
We offer free hosting tiers to support individuals and startups. To maintain network quality, these accounts are governed by strict conditions:
- Immediate Deployment: The website must be ready to upload and go live immediately upon account activation.
- Legitimate Projects Only: The project must be authentic, featuring active social media links visibly integrated into the site.
- Prohibited Uses: Free tiers may not be used for software testing, staging environments, or file storage/archiving.
- Eligibility: Restricted to individuals and emerging startups. Established businesses capable of affording standard plans (starting at $1.99/mo) are not eligible.
- Audits & Termination: Free accounts are subjected to routine audits. Any violation of these terms will result in immediate account termination and data deletion without prior notice or compensation.
10. Reseller Accounts
- Resellers are solely responsible for providing first-line technical support to their end-users. JordanHost LLC does not provide direct support to a Reseller’s clients.
- The Reseller holds full legal responsibility for all content hosted by their clients and agrees to indemnify the Platform against any legal or financial claims arising from their end-users' violations, including violations of the Zero-Tolerance Acceptable Use Policy in Section 7.
11. Export Control, Sanctions & Financial Compliance (AML)
JordanHost LLC is a United States legal entity registered in the State of Wyoming and is subject to U.S. export control laws, economic sanctions programs, and the compliance requirements of its U.S. payment processors and banking partners (including, without limitation, Stripe and U.S. banking institutions). Strict adherence to these laws is a non-negotiable condition of our operations and takes precedence over any commercial consideration.
11.1 Restricted & High-Risk Jurisdictions
- Absolute Right of Refusal: JordanHost LLC reserves the unilateral, absolute, and sole discretionary right to refuse, restrict, suspend, or immediately terminate any service — at any time, without prior notice, without any liability whatsoever, and without any refund of amounts paid — to any individual, business, or entity that is located in, organized under the laws of, ordinarily resident in, or accessing our services from any high-risk, sanctioned, embargoed, or disputed jurisdiction.
- Restricted Jurisdictions (Non-Exhaustive Examples): Restricted jurisdictions include, by way of example and without limitation, the Islamic Republic of Iran, the Republic of Yemen, and the Russian Federation, as well as any other country, territory, or region designated by us as high-risk.
- Catch-All Provision: The restriction extends automatically — without any need to amend this Agreement — to any country, government, territory, or region that is or becomes subject to comprehensive or targeted sanctions, embargoes, or restrictive measures administered by the U.S. Office of Foreign Assets Control (OFAC), the U.S. Department of Commerce (BIS), the United Nations Security Council, the European Union, the United Kingdom (OFSI), or any other applicable international authority, and to any individual or entity named on any sanctions, denied-persons, or restricted-parties list maintained by such authorities (including the OFAC SDN List).
- Sole Determination: The determination of whether any client, jurisdiction, transaction, or pattern of access falls within the scope of this Section rests solely and exclusively with JordanHost LLC. We are under no obligation to justify, explain, or substantiate any refusal or termination made under this Section, and such determination shall be final and non-appealable.
11.2 Client Representations & Warranties
By purchasing or using any service, you represent, warrant, and covenant on a continuing basis that:
- You are not located in, organized under the laws of, or ordinarily resident in any Restricted Jurisdiction as defined in Section 11.1;
- You are not named on, owned by, or controlled by (directly or indirectly, in whole or in part) any person or entity named on any applicable sanctions or restricted-parties list;
- You will not access, use, resell, sublicense, export, re-export, or make available our services, infrastructure, or software to or for the benefit of any Restricted Jurisdiction or any sanctioned or restricted person or entity;
- You will not use VPNs, proxies, false location data, nominee accounts, or any other means to conceal or misrepresent your identity, location, ownership, or the ultimate beneficiary of the services.
Any breach of these representations constitutes a material breach of this Agreement, entitles us to immediate termination of all services without notice or refund, voids any otherwise-applicable money-back guarantee, and obligates you to indemnify JordanHost LLC in full against any fines, penalties, processor holds, account closures, or losses arising from such breach.
11.3 Screening, Geo-Blocking & Compliance Measures
- Screening Rights: We reserve the right to screen all clients, orders, and payments against applicable sanctions and restricted-parties lists at any time, to employ IP-based geo-blocking and fraud-detection systems, to decline transactions originating from anonymizing services, and to request documentary proof of identity, residence, and beneficial ownership at any point during the service relationship.
- Freezing & Reporting: Where required by law or by our payment processors and banking partners, we may freeze services, withhold funds, block transactions, and report accounts or transactions to the competent authorities without notifying the client, and we shall bear no liability for doing so.
- No Waiver: The provision of services to any client at any point in time shall not constitute a waiver of our rights under this Section, which may be exercised at any moment, including against existing clients whose circumstances, location, or legal status change.
11.4 Anti-Money Laundering (AML)
- AML Compliance: As a United States legal entity, JordanHost LLC operates in accordance with applicable U.S. anti-money laundering laws, including the Bank Secrecy Act (BSA) and related regulations. We do not permit our services or payment channels to be used for money laundering, terrorist financing, or the concealment of proceeds of crime, and we may report suspicious transactions to the competent authorities.
- Payment Processor & Banking Requirements: Our payment processing and banking relationships impose their own compliance requirements. You agree to cooperate with any information request reasonably necessary for us to satisfy those requirements, and you acknowledge that failure to cooperate may result in suspension of billing or services.
12. Limitation of Liability & Indemnification
- Services Provided "As Is": Except as expressly stated in this Agreement, all services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Disclaimer of Damages: To the maximum extent permitted by law, JordanHost LLC, its members, managers, officers, employees, and agents shall not be held liable for any indirect, incidental, special, punitive, or consequential damages, including loss of revenue, profits, goodwill, or data, arising from the use of or inability to use our services, except as explicitly stated in the "VIP Care (Enterprise Care)" plan.
- Liability Cap: In all circumstances, our maximum aggregate financial liability to you for any and all claims shall not exceed the total amount paid by you to us during the three (3) months immediately preceding the event giving rise to the claim.
- Indemnification: You agree to indemnify, defend, and hold harmless JordanHost LLC against any claims, liabilities, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the services, violation of this Agreement, or infringement of third-party rights.
13. Governing Law & Dispute Resolution
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict-of-law principles.
- Jurisdiction & Venue: The state and federal courts located in the State of Wyoming shall have exclusive jurisdiction over any dispute, claim, or controversy arising out of or relating to this Agreement or the services, and each party irrevocably consents to the personal jurisdiction and venue of such courts.
- Informal Resolution First: Before initiating any formal proceeding, the Client agrees to first contact us in writing and allow thirty (30) days for a good-faith attempt to resolve the dispute amicably.
- Class Action Waiver: To the extent permitted by law, all claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
14. General Provisions
- Price Adjustments: We reserve the right to modify pricing. Clients will receive a thirty (30) day notice prior to any price change taking effect on their active plans.
- Amendments to Terms: We reserve the right to update this Agreement at any time. Continued use of our services following the publication of changes constitutes your binding acceptance of the updated terms.
- Termination Rights: We reserve the right to suspend or terminate services, in whole or in part, without prior notice for late payments, breaches of this Agreement, or any activity that harms the Platform's infrastructure or reputation.
- Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Entire Agreement: This Agreement, together with our Refund and Cancellation Policy and any executed SLA contracts, constitutes the entire agreement between the Client and JordanHost LLC regarding the services.
